Membership Terms & Conditions

Membership Terms & Conditions for FLINTSHIRE WELLBEING LTD T.A. LyonsDen Fitness (“The Company, The Club”) At LyonsDen Fitness Centre, Boot End, Bagillt, Flintshire, CH6 6HD

 

1.  Operation of the Facilities

a)  We FLINTSHIRE WELLBEING LTD  as LyonsDen Fitness Centre (the club) shall through our duty or authorised representatives manage and operate the facilities of the club and deal with all matters relating thereto.

b)  All monies paid by you to the club (including without limitations, entrance fees, subscriptions and other receipts) shall remain the property of the club and in no circumstances shall any distributions of monies be made to you whether on termination of your membership at the club or otherwise unless we are in breach of contract..

 

    1. All personal data shall be treated with discretion, and the club will adhere strictly to the data protection act.
    2. The club operates CCTV within the centre predominantly but not limited to security, health and safety, staffing and crime prevention purposes, the recordings are only in public areas and control of the recording is limited to LyonsDen Senior Staff.  In normal circumstances the information is recorded, processed and stored in line with the Information Commissioners Office (ICO) guidelines.

 

2.  Interpretation and variation

a)  These are the terms & conditions of Membership (“Terms & Conditions”) incorporated into the membership agreement between the company and each Member (“the Membership Agreement”).

The Company reserves the right to vary and revoke these Terms & Conditions from time to time and in addition to make, vary and revoke any bye-laws which it may consider necessary or desirable for the regulation of the internal affairs of the club and the conduct of members and their guests.  Any such changes will be notified to members and, until revoked, are binding on members.  Any significant changes would be discuss between the two parties and an agreement would be concluded.

These Terms & Conditions shall be governed by the laws of Wales and subject to the exclusive jurisdiction of the Welsh courts.

 

3.  Membership Card

a)  Membership cards remain the property of the Company and the Company reserves the right to retain any membership card if there has been a defaulted payment by the member concerned.

b)  Any member who loses his/her card may apply for a replacement, for which a charge of £5 will be made.

c)  The membership card must:

c.1)  be presented as requested on each visit to the club, failing which an admission fee will be charged.

c.2)  only be used by the person to whom it is issued (abuse will lead to forfeiture).

 

4.  Assignment

a)  The club may assign the benefit of this Agreement to a third party (offering similar benefits) at any time notification will be given to the Member. 

b)  Membership of the club is personal to the member and may not be assigned or transferred unless agreed by management (discretionary) and subject to an administration fee and induction fee where applicable.

 

5.  Club Facilities

 

    1. Use of the club facilities is subject to availability and safety with regard to attendance levels and the condition of equipment.
    2. Priority booking of classes or facilities is available to appropriate members between 3 days and 24hrs prior to proposed attendance, and is given on a first come first served basis up until the list is full.  Members or pay as you go class attendees without priority can take any remaining places.
    3. There will be a no show fee enforced for each non attendant, a repeated no show will result in loss of booking privileges.
    4. Holders of Gym Only Membership will be able to attend studio classes at a reduced rate (50%), but with the same restrictions on booking as pay and go clients.
    5. Holders of Studio membership will be entitled to the use the gym for a fee of £4 per visit.
    6. Certain categories of membership do not include all the clubs services and facilities.  These services and facilities may be provided for an additional charge at the clubs discretion.
    7. The club reserves the right to make reasonable alterations to the types of facilities provided but will give notice, however the club shall not be liable for any loss occasioned by such alterations.

 

6.  Liability

a)  The club shall not be liable for death or personal injury to you or your guests whilst at the club except to the extent that such death or personal injury arises from negligent act or omission by us.

b)   Members and guests will keep us fully indemnified against any liability, costs, or damaged and expenses incurred by us as a result of any breach by themselves of these rules.

c)  The club shall not in any circumstances accept any responsibility for members’ personal belongings.  Lockers are provided and are available to all members.  Any contents removed from lockers or other lost property can be claimed from reception for up to six weeks.  After this time, the items will be donated to local charities.  Any loss or damage to members’ personal property is therefore strictly limited to that specifically caused as a result of negligence of the club.

d)  The club cannot accept any liability for any accident to any member that may occur on the premises or within the grounds of the club other than any liability that may arise from the negligence of the club or its staff.  Any member who suffers an accident on the club premises must report the accident and circumstance to the duty manager immediately following the accident.

e)  Vehicles parked in the club car parks or elsewhere on the club premises and all contents in them are left at the owner’s risk and the club will accept no liability for loss or damage arising unless any loss is a direct result of our negligence.

 

7.  Conditions of Opening

a)  LyonsDen Fitness Club’s operating hours will be made available to members on request.  The Club reserves the right to change the hours of opening at its sole discretion.

b)  Changes of operating hours will be notified to members.

c)  Shutting down of facilities for service or repair will be notified as early as possible and kept as short as possible.

d)  There will be no reimbursement of membership fees for loss of any service or facilities due to any reason including service, repair, and maintenance.

e)  The club reserves the right to close on public holidays.

f)  The club reserves the right to close or partially close for up to 2 weeks (excluding public holidays) in any six-month period.  Should this become necessary as much notice as possible will be given, and we will endeavour to carry out as much maintenance as possible.

 

8.  Club By-Laws & Conditions

a)  No member shall be permitted to enter the club without first producing his/her membership card.  Members who continually fail to produce their card will be charged an administration fee.

b)  Members and their guests shall at all times maintain an appropriate state of dress.  Members and guests not complying with this requirement shall be refused entry.  Members shall wear suitable dress and apparel when utilising the clubs facilities and in particular non-marking shoes shall be worn where appropriate.  Members and guests are requested to shower and change before using the social areas.

c)  Smoking is prohibited in all parts of the clubs premises.

d)  At all times members will show consideration for residents of the area surrounding the club both whilst at the club premises and when entering & leaving the club premises and in particular will leave quietly, especially early in the morning & late at night.

e)  Any member or their guest will report breakages or any failure of any equipment immediately.

f)   Members and their guests must leave club premises prior to closing time and should allow ample time for showering and dressing.

 

9.  Health Suite, “Wet Area Facilities”

a)  Members and their guests must wear suitable clothing in each of the sauna and steam rooms.

b)  All members and their guests use the “wet area facilities” at their own risk unless any injury or loss was a direct result of our negligence.

c)  The club reserves the rights to close the health suite for other activities.  Prior notice will be displayed on the notice boards.

d)  Shaving is not permitted in the sauna or steam room.

e)  Members and guests with the following conditions should not use the sauna, steam room or spa bath: low/high blood pressure, cardiac irregularities, asthma and pregnancy.  If there is any doubt, the member or guest should consult his/her doctor.

f)  For safety reasons members should spend no longer than 15 minutes in a sauna or steam room.

g)  No drinks or food shall be taken into the health suite at any time, water with cups will be supplied for re-hydration.

h)  Running, jumping or unruly behaviour is prohibited in the wet area.

 

10.  Therapy/personal training

a)  Therapist & personal trainers working within the club on a self-employed basis and therefore responsible for themselves, the club will not accept liability for any treatments received by members.

b)  Members can obtain information regarding treatments from the clubs reception.

c)  Booking of therapy treatments and personal training sessions may be made by dialling the clubs reception on 01352 711433 or directly with the therapist/personal trainer.

 

11.  Physical conditions

a)  Members & guests are advised to undergo a medical examination prior to beginning any physical activity programme.  In particular, without limitation, if you are pregnant or suffer from diabetes, heart disease, high or low blood pressure you should consult your doctor to check which, if any of the facilities at the club you should not use.

b)  The club will not offer medical advice at any time.

c)  Members who suffer from a medical condition that may be affected by activities offered by the club must inform the club immediately.

d)   Members who suffer from any medical condition that may affect or be hazardous/infectious to staff or other members must inform the club immediately.

e)  Nobody must use the club facilities while suffering from any infectious or contagious illness, disease or other ailments which could prove hazardous to staff or other members.

f)   Open cuts; sores or abrasions must be made safe (both physical and visual) from any risk of infection, discomfort or physical condition of staff or other members.

 

12.  Safety & Hygiene

a)  No pets (with the exception of guide dogs) are permitted in the club building or grounds.

b)  Members and guests must use the main entrance when entering and exiting the building.

c)  Fire exists, which are clearly marked are there in the interests of safety and members and their guests must not interfere with these doors for any reason.

d)  In the event of a fire members and guests are asked to make their way to the nearest available exit.

e)  Cars must be parked in the marked areas only and must not block service roads.

f)  No hot drinks or food shall be taken into the Gym, Studios or health suite at any time.

 

13.  Under 18 / Children

a)  Children between the ages of 12-16 may become members of the club and be able to use the clubs facilities only when accompanied by a parent or guardian.

b)  Children between the ages of 16-18 may become members of the centre and be able to use the clubs facilities only when the club has received written consent from a parent or guardian.

c)  Children under the age of 12 may use the clubs facilities only when specified for a scheduled, pre-arranged activity, and parental or guardian consent must be giving to the organising body for the said activity they are attending.

 

14.  The Acceptance

a)   Every candidate for membership must apply for membership on the prescribed application form, which must be accompanied by the corresponding membership fee and membership subscription at the prevailing rate.  The management reserve the right to reject any application or renewal of membership without giving reason for its decision.   This decision is at the absolute discretion of the club. 

b)  If accepted by the club, membership of the club by the applicant shall commence upon the date of acceptance.  Upon acceptance, the Member shall be issued with a Membership Card (which shall remain the property of the club) personal to him/her and shall be entitled to all the rights and privileges exercisable by the class of members for which his/her application for membership has been accepted. 

c)  ACCEPTANCE BY THE CLUB OF AN APPLICATION FOR MEMBERSHIP OF THE CLUB SHALL CONSTITUTE A BINDING CONTRACTUAL ARRANGEMENT BETWEEN THE CLUB AND THE APPLICANT UPON THESE TERMS AND CONDITIONS OF MEMBERSHIP AND THE RULES AND REGULATIONS OF THE CLUB AS ARE FROM TIME TO TIME IN FORCE.

d)  Continuation of membership will be at the sole discretion of the club and reliant on the applicant maintaining a level of conduct that is deemed seemly to the other members and staff.  Bad language, unseemly gesturing, personal or loud abuse, states of undress or inappropriate clothing will be seen as unacceptable.

 

101.  Membership

a)    Membership is subject to a minimum 3 month contract, and should only be entered into if the applicant wishes to be bound by its contents (refer to section 16c).

b)    Members are required to give written notice to the club of any change of address.  Failing such notice, all communications shall be assumed to have been received by the member within 5 days of mailing to the last address notified to the club.

c)     The club may, if members so wishes communicate with the member by electronic mail (email).  By providing an email address to the club the member consents to receiving email communications from the club, including notices pursuant to these Terms & Conditions.  The member also accepts the risk that email may not be a secure and confidential means of communication.  The club will not be liable for any loses or damage suffered as a result of communicating with a member by email unless this was caused by a direct result of our negligence.

d)   The management and staff reserve the right to refuse admission to the club for which an explanation would be given.

e)   The management reserves the right to refuse or cancel membership for which an explanation would be given.

f)     A person who is not a party to the Membership Agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Membership Agreement.  However if payment by a third party is made to the club, for example as a gift for a relative, then rights would apply to the named person.

g)    Memberships can be upgraded or downgraded at managements discretion up to twice in any 6 month period and will be subject to a fee of £5.  An upgrade will require an immediate pro-rata payment to take effect.  A downgrade will take place from the next due payment.

Discounts will only be for the specified or initial period of membership and will not automatically exceed 6 months.

 

102.  Payment Terms 

Preferred payment method for membership is monthly Standing Order – though other payment methods may be discussed on an individual basis, and entirely at the clubs discretion.  At the end of the initial period the monthly payment will continue and membership will be taken on a rolling periodic basis, with a minimum 1-month full notice to cancel after the initial period.

b)   A Joining Fee is only charged when minimum terms are not met, or the minimum term is defaulted.  In those cases a combined joining and an induction fee equal to £100 or part thereof is chargeable at the time of joining or upon default, this fee is waived on commitment to and completion of the minimum term.  These fees if charged are non-refundable by the club to the member and does not confer on the member any rights of transfer.

c)   Members should not alter payments without arrangements, and prior agreement with the club.

d)  The provision of this clause will only apply if you pay by monthly Standing Order.

d.1.  This clause constitutes your advance notice of payments to be Paid by Standing Order.

d.2.  The first subscription fee that a member will pay on joining the club will include (if applicable) any joining and induction fee plus the 1st months gym membership instalment, determined by membership type specified on the application form, this is non refundable at the sole discretion of the club.

d.3  Depending on the date at which the membership commences the normal subscription fee will then be paid to the club by Standing Order on or before the arranged working date of each calendar month.

e)  Monthly subscription fees must be paid in accordance with these Terms & Conditions irrespective of whether the member uses the clubs facilities or membership has been terminated.  Members will still be liable to settle any outstanding sums owed to the Club. Any failure to abide by payment terms may result in the full debt to be passed onto a collection agency, who will seek to recover the full debt plus fees and costs.

f)  Members shall be given no less than 10 working days’ written notice of any increase in the monthly subscription fee, and if applicable the Standing order amended, or a new Standing order set up.

g)  Monthly payments must be made on the agreed date.

 

    • This is a Minimum TERM contract OF 3 MONTHS UNLESS OTHERWISE STATED.
    • Under 18’s must have a guardian countersign for them.
    • The club must be notified before any variation in payment due to change in circumstance, E.G. Sickness, relocation, unemployment, Pregnancy etc.
    • Valid Change of circumstance does not include luxury items such as car purchase, holiday etc.
    • Written Proof of change of circumstance must be provided.
